GENERAL TERMS AND CONDITIONS

WeTuscany is not a party to any contractual relationship between the Traveller and the Owner, and does not mediate between the Traveller and the Owner. The Site acts only as a venue to interact. The Rental Contract is always between the Traveller and the Owner. Making a reservation will be considered as an acceptance of the following conditions:

DEFINITIONS

“Owner” is the person allowed to represent legally the property object of a booking.
“Traveller” shall mean the person in whose name the booking is made, and it shall include the person or persons on whose behalf the same is made.
“The Property” shall mean the accommodation, the grounds, the pool, the facilities rented by the Traveller.
“The Company” shall mean “We Tuscany”.

BOOKINGS

When The Traveller makes a reservation, they agree to these general terms and conditions and they agree to the specific property policies of the accommodation, when indicated.

TERMS OF PAYMENT

The whole rental price will be paid by the 14th day from arrival in order to finalize the reservation.
In case of bookings created 14 days or less from arrival, the whole rental price must be paid at reservation.
If the above-mentioned amount is not received within the due date, the Company shall be entitled to cancel the booking regardless of the Traveller’s consent.
These terms shall not apply to those accommodations which present specific terms of payment, as indicated in their local policies.

CANCELLATION BY THE TRAVELLER

Any cancellation must be communicated via email from the person who made the booking.
Cancellation of a booking, unless stated otherwise in the local policies of the Property, entails the following penalties: 100% of the total rental price if the cancellation is made 14 days or less from the day of arrival or in case of no show.

INSURANCE

It’s highly recommended taking out a travel insurance including coverage against trip cancellation.

CANCELLATION / ALTERATION BY THE COMPANY

Though it is unlikely the occurency of any changes to confirmed arrangements, it can occasionally happen. In this case the Traveller will be advised at the earliest date possible. If for any reason beyond the Company’s or the Owner’s control it is impossible to provide the Traveller with the Property originally booked, a similar property will be provided.
However, if this is not possible or if the Traveller does not wish to be transferred, the booking will be cancelled and the amount already paid for the Property will be refunded.
Nor the Company nor the Owner will be liable in any case for any cancellation charges linked to other travel arrangements.

UPON ARRIVAL

On arrival the Traveller and their party must present passports or identity cards to the Owner to proceed with their registration in accordance with legal requirements. If the property is a private house, a short term rental contract must be signed upon arrival.

ARRIVAL AND DEPARTURE TIMES

Standard check in time goes from 3 p.m. to 7 p.m.
Standard check out time is within 10 a.m.
If the Traveller wishes to arrange arrival or departure at different times, this must be agreed in advance and in writing with The Company.
In case of flight delays or any inconvenient while travelling, the Traveller should contact The Company or their Check In Referent as soon as possible.
Late arrivals are difficult to organize and when it is possible to arrange them an extra fee could be applied. This must be paid directly to the key holder upon arrival.
Please note that in the majority of cases, it is not possible to arrange arrivals after 9 p.m. It is up to the key holder’s discretion to decide whether or not to allow the Traveller and their party to enter the house at times other than those stated.
The Company declines all responsibility in the matter.
Before departure the Traveller must be sure to do the following:
take out all trash, turn off lights, close all windows, leave the keys on the table / return them to the key holder.

SECURITY DEPOSIT

When the keys are handed over to the Traveller, the security deposit indicated on the Property’s local policies must be paid, in cash and in EURO to the Owner or their representative. Such amount will be refunded at the end of the stay less any deduction made for damage caused to the Property by the Traveller or someone from their group.

NUMBER OF PERSONS/SUBSTITUTIONS

The person whose name appears on the reservation is the referent for the use of the Property. The number of persons who can be accommodated in each property is indicated in the property’s local policies. This number may not be exceeded. The substitution of persons during the rental period is forbidden unless previously agreed upon with the Owner. Access to the Property is restricted to the Traveller and their party, as indicated in the booking, any visit of other people, even if occasional, will have to be authorized in advance by the Owner.

CHILDREN & INFANTS

Infants sleeping in a baby cot are not included in occupancy figures. However a few owners do not accept children or infants, thus the Company requires to be informed on the presence of children or infants. In case baby cots/high chairs are needed, the Traveller will have to let the Company know with due advance.

BEHAVIOUR

The Traveller signing the contract is responsible for their correct and decent behaviour and their party’s. Should the Traveller and their party behave in a manner that is not acceptable by civilised standards, the key holder may ask them to vacate the house.

PETS

The possibility to bring along pets is indicated in each property’s local policies, however a confirmation from the Owner is required. The Traveller is obliged to warn the Owner at the time of booking if they are bringing any pet.
In case a charge for pets is requested, this should be paid directly to the Owner.

BREAKAGE & DAMAGE

The Traveller is liable for any damages caused to the Property, its contents or the grounds by them and by any member of their party. Any damage, breakage or breakdown must be reported to the Owner, caretaker or person who is responsible for assisting the Traveller during their stay.

SWIMMING POOLS

The use of swimming pools is strictly at the Traveller’s own risk and children must be supervised at all times. The Traveller and their party are required to follow the regulation exposed by the Owner.

UTILITY

The use of gas, electricity, water and heating, unless otherwise indicated is included in the rental price. Please note that the use of heating (when it can be switched on and off, temperature, etc.) is controlled by regulations which vary from region to region. Heating appliances may be switched on only between November and April.

WATER AND ELECTRICITY

Please note that most of the properties offered on this web site are not the typical purpose-built Mediterranean holiday villas. Most are converted farmhouses or former manor houses, full of character and history. Water shortages may occasionally occur. Water is to be used sparingly during the summer months.
At the same time, Italy is probably one of the few countries in the world where the government has introduced a system of electricity limiters to contain national consumption. This means you must be careful when using more than one appliance at once because the limiter will shut electricity off.

STANDARD EQUIPMENT

Properties are let fully furnished and equipped, including crockery, cutlery, bed and bath linen sufficient for the number of people indicated in the booking, fresh linens and towels are provided weekly. Bed-linen for the cot is not usually provided by the Owner.

CLEANING

Unless otherwise indicated, final cleaning service is included in the rental price.
Cleaning service during the stay is not included.
In case it was needed, a separate agreement between the Traveller and the Owner is required.

EXTERNAL MAINTENANCE

The Owner or their representative reserves the right to have free access to the property for essential maintenance purposes (garden, swimming-pool etc…).

COMMERCIAL USE / PARTIES & WEDDINGS / OTHER ACTIVITIES

Should the Traveller intend to use the Property for any type of commercial use such as photo shoots or filming, this should immediately be advised at the time of booking. Such use will only be allowed with the written consent of the Company, who in turn will implement specific arrangements and stipulations thus imposed by the Owner. No private parties, weddings, wedding receptions or large gatherings are allowed in the properties without written permission from the Company.
No camping is permitted on the Property grounds.

COMPLAINTS

The Owner ensures that their Property is in a reasonable condition. If there are any problems, it is the Travellers’s responsibility to notify the Owner/caretaker of the Property promptly so that they can take the actions required.
If the Traveller has any problem during their stay which cannot be satisfied by dealing directly with the Owner or manager of the Property, the Company should be contacted immediately. No compensation from the Owner will be claimed, unless promptly manifested during the stay.
Complaints lodged only at the end of the stay will not be taken into consideration. Travellers who
abandon the house without authorization from the Company lose all rights to any refund or rebate.

INTERNET CONNECTION

Most of the properties have an internet connection. When a connection is interrupted due to technical reasons beyond the Company’s or the Owner’s control, it is unfortunately very difficult to receive immediate assistance from some of the internet providers operating in Italy. Its is therefore strongly suggested that those who need to constantly access the internet should not only rely on the internet at the Property. In case of a lack of internet connection not attributable to the Company or to the Owner, none of these two will accept any responsibility.

VALUABLES

Valuables left at the Property are at the travellers’ risk. Neither the Company nor the Owner (nor their staff) are responsible for their loss.

FORCE MAJEURE

“Force Majeure” shall mean any event outside the Company’s or the Owner’s control which prevents the prompt performance of their obligations, including war or threat of war, riot, civil strife, industrial disputes, terrorist activity, natural disaster, fire, epidemic, outbreaks of illness, or adverse weather conditions.
The Owner and/or the Company assumes no liability in relation to any alteration, delay, cancellation or any other loss or damage of any kind caused by events outside their control, or any other circumstances or events due because of “Force Majeure”.

LIABILITY OF THE COMPANY

The descriptions on this website are made very carefully and in good faith. The Company visit their properties to ensure the accuracy of descriptions. It also relies upon information given by the owners. The Company will not be liable for any modifications introduced by property owners without their knowledge.

INTELLECTUAL PROPERTY

All contents contained in this website are property of the Company and may not be used without the consent of the Company. All rights reserved.

PRIVACY
The Company will use the personal information provided by the Owner and the Traveller for the sole purpose to manage the mentioned services according to the law on protection of personal data (GDPR 679/2016, D.LGSL. 196/2003 e ss.mm.). Further details from the Privacy Policy.

LAW-JURISDICTION

In the event of any dispute concerning the terms and conditions of this contract, the court of law of Siena will have jurisdiction and Italian Law will be applied. On filling the Booking Form the Traveller totally and unconditionally accepts the Company’s Booking Conditions.
