GENERAL TERMS AND CONDITIONS

WeTuscany is not a party to any contractual relationship between the Traveller and the Owner, and does not mediate between the Traveller and the Owner. The Site acts only as a venue to interact each other. The Rental Contract is always between the Traveller and the Owner. By making a reservation will be taken as your and your party’s acceptance of the following conditions:

DEFINITIONS

“The Owner” is the person allowed to represent legally the property object of a booking.
“The Traveller” shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same is made.
“The Property” shall mean the accommodation, the grounds, the pool, the facilities rented by the Client.
“The Company” shall mean “We Tuscany”.

BOOKINGS

When The Traveller makes a reservation, he/she agrees to this general terms and conditions and he/she agrees with the property policies as indicated in its section. Once the Owner received your payment, the booking will be considered confirmed and a confirmation will be issued to the Traveller by the Company.

TERMS OF PAYMENT

The initial deposit required to confirm a booking is 20% of the total rent amount which is payable at the time of the booking. The balance is due 14 days before arrival. For bookings within 14 days of arrival the full amount must be paid at the time of the booking. If the balance is not received by the company by the due date, the company shall be entitled to cancel the booking without prejudice to our claim for cancellation charges, and to retain the deposit.

CANCELLATION BY THE TRAVELLER

Any cancellation must be communicated via email from the person who made the booking.
Cancellation of a booking, unless stated otherwise in the local policies of the property, the following penalties must be paid: 20% of the total rental price if the cancellation is made from the booking time to 15 days before the start of the rental period, 100% of the total rental price if the cancellation is made from 14 days to the day of arrival or in the case of no show.

INSURANCE

We highly recommend that you take out Travel Insurance including coverage against trip cancellation.

CANCELLATION / ALTERATION BY THE COMPANY

Though it is unlikely that we will have to make any changes to confirmed arrangements, it does occasionally happen, and we will advise you at the earliest possible date. If for any reason beyond our control we are unable to provide you with the property you have booked, we reserve the right to transfer you to a similar property.
However, if this is not possible or you do not wish to be transferred, we will cancel the booking and refund the amount paid to us for the property, but we will not be liable for any cancellation charges for travel arrangements.

UPON ARRIVAL

On arrival the Traveller must present his rental voucher as well as his passport or identity card to the Owner or his representative to enable them to proceed with their registration in accordance with legal requirements. As you are aware, some of the properties are private houses, in that case a rental contract for the rental of a holiday apartment must be signed upon arrival.

ARRIVAL AND DEPARTURE TIMES

The arrival and departure times are indicated in the local policies at each Property’s section on this web site.
If you wish to arrange arrival or departure at different times than those one stated, this must be agreed in advance and in writing with We Tuscany.
In case of flight delays or any inconvenient while travelling, clients should contact We Tuscany or the property contact.
Late arrivals are difficult to be organized and when it is possible to arrange them an extra fee could be applied. This must be paid directly to the key holder upon arrival.
Please note that in the majority of cases, it is not possible to arrange arrivals after 9 p.m. It is up to the key holder’s discretion to decide whether or not to allow clients to enter the house at times other than those stated. We Tuscany declines all responsibility in the matter.
Before departure please be sure to do the following:
Take out all trash, turn off lights, close all windows, leave the keys on the table / return them to the keyholder.

SECURITY DEPOSIT

When the keys are handed over to the Traveller, the security deposit, as indicated on the property’s local policies must be paid, in cash and in EURO to the owner or his representative. Such amount will be refunded at the end of the holiday less any deduction made for damage caused to the Property.

NUMBER OF PERSONS/SUBSTITUTIONS

The person whose name appears on the voucher is the referent for the use of the Property. The number of persons who can be accommodated in each Property is indicated in the property’s local policies. This number may not be exceeded. The substitution of persons during the rental period is forbidden unless previously agreed upon with the Owner. Access to the Property is restricted to the Traveller and his party, as indicated on the booking confirmation, any visit of other people, even if occasional, will have to be authorized in advance by the Owner.

CHILDREN & INFANTS

Infants sleeping in a baby cot are not included in occupancy figures. However a few owners do not accept children or infants thus we require to be informed on whether you are travelling with children or infants. Please note that not all houses have cots or high chairs, so please let us know if you need any.

BEHAVIOUR

The client signing the contract is responsible for the correct and decent behaviour of his party. Should the client and his party behave in a manner that is not acceptable by civilised standards, the key holder may ask the client and his party to vacate the house.

PETS

The possibility of bring along pets is indicated in each property’s local policies, however a confirmation from the owner is required. The traveller is obliged to warn the Owner at the time of booking if he is bringing any pet.
In case a charge for pets is requested, this should be paid directly to the Owner.

BREAKAGE & DAMAGE

The Traveller is liable for any damages caused to the property, its contents or the grounds by any member of his party. Any damage, breakage or breakdown must be reported to the Owner, caretaker or person who is responsible for assisting Travellers during their stay.

SWIMMING POOLS

Use of these swimming pools is strictly at the clients’ own risk and children must be supervised at all times. Travellers are required to follow the regulation exposed by the Owner.

UTILITY

The use of gas, electricity, water, heating , unless otherwise indicated are included in the rental price.Please note that the use of heating (when it can be switched on and off, temperature, etc.) is controlled by regulations which vary from region to region. Heating appliances may be switched on only between November and April.

WATER AND ELECTRICITY

Please note that most of the properties that we offer are not the typical purpose-built Mediterranean holiday villas. Most are converted farmhouses or former manor houses, full of character and history. Water shortages may occasionally occur; please use it sparingly during the summer months.
At the same time, Italy is probably one of the few countries in the world where the government has introduced a system of electricity limiters to contain the national consumption. This means you must be careful when using more than one appliance at once because the limiter will shut the electricity off.

STANDARD EQUIPMENT

Properties are let fully furnished and equipped, including crockery, cutlery, bed and bath linen sufficient for the number of people indicated, fresh linens and towels are provided weekly. Bed-linen for the cot, usually is not provided by the Owner.

CLEANING

Unless otherwise indicated are included in the rental price.

EXTERNAL MAINTENANCE

The Owner or his representative reserve the right to have free access to the property for essential maintenance purposes (garden, swimming-pool etc…).

COMMERCIAL USE / PARTIES & WEDDINGS / OTHER ACTIVITIES

Should clients intend to use a property for any type of commercial use such as photo shoots or filming, this should immediately be advised at the time of booking. Such use will only be allowed with the written consent of We Tuscany, who in turn will implement specific arrangements and stipulations thus imposed by the
property owner. No private parties, weddings, wedding receptions or large gatherings are allowed in the properties without written permission from We Tuscany .
No camping is permitted on the property grounds.

COMPLAINTS

The Owner ensure that their Property is in a reasonable condition, If there are any problems, it is the Travellers’s responsibility to notify the Owner/caretaker of the Property promptly so that he/she can take the action required.
If you have any problem during your stay which cannot be satisfied by dealing directly with the owner or manager of the property, you should contact us immediately. It is impossible for us to claim compensation from the owner after you have returned from your holiday if you have not recorded the problems with us during your stay.
Complaints lodged only at the end of the holiday period will not be taken into consideration. Clients who
abandon the house without authorization from We Tuscany lose all rights to any eventual refund or rebate.

INTERNET CONNECTION

Most of the properties have an internet connection. From our experience, when a connection is interrupted due to technical reasons beyond our control, it is unfortunately very difficult, despite our efforts, to receive immediate assistance from some of the internet providers operating in Italy. We therefore strongly suggest that those who need to constantly access the internet should not only rely on the internet at the property. Please note that in any case we cannot accept responsibility for lack of Internet Connection.

VALUABLES

Valuables left at the property are at the clients risk. Neither We Tuscany nor the owners (nor their staff) are responsible for their loss.

FORCE MAJEURE

Force Majeure” shall mean any event outside the Company’s or the Owner control which prevents the prompt performance of its obligations, including war or threat of war, riot, civil strife, industrial disputes, terrorist activity, natural disaster, fire, epidemic, outbreaks of illness, or adverse weather conditions. The Owner and/or the Company assumes no liability in relation to any alteration, delay, cancellation or any other loss or damage of any kind caused by events outside his control, or any other circumstances or events due because of “Force Majeure”.

LIABILITY OF THE COMPANY

The descriptions on this website are made very carefully and in good faith. We visit properties to ensure the accuracy of descriptions. We also rely upon information given to us by the Owners. However, we shall not be liable for any modifications introduced by the Property Owners without our knowledge.

INTELLECTUAL PROPERTY

All contents contained in this website is property of the Company and may not be used without the consent of the Company. All rights reserved.

PRIVACY

The Company will use the personal information provided by the Owner and the Traveller for the sole purpose to better manage the services mentioned and according to the law on protection of personal data. Further details from the Privacy Policy.

LAW-JURISDICTION

In the event of any dispute concerning the terms and conditions of this contract, the court of law of Siena will have jurisdiction and Italian Law will be applied. On signing the Booking form the client totally and unconditionally accepts We Tuscany Booking Conditions.
